What you need to know…

What’s the law? Is this a criminal matter?

The Police can prosecute someone for domestic abuse under laws about assault, harassment, sexual offences etc. However, sometimes they do not. Why is this? The Police are well trained in abuse recognition, but they have heavy evidential hurdles to cross.

The Crown Prosecution Service will need to convince a jury or a Magistrates court that they are sure that the accused person committed the offence. That is a 99.99% burden of proof, also known as ‘beyond reasonable doubt’.

So when there are only two parties to an argument, or the allegations are quite historic with little supporting evidence, the Police can be reluctant to charge an alleged offender with an offence, leading to frustration for them and for you.
