AI and Family Law – What You Should Know
When you’re facing a family law issue, the first thing most people do is turn to the internet. It’s fast, it’s free, and it feels like a safe way to get information.
These days, we are in the meteoric rise of AI and there is no doubt that more and more people are turning to it before they even think about seeing a solicitor.
But there is a massive difference between gathering information and getting legal advice. In the world of private family law, relying on AI isn’t just risky, it can be a disaster for your case.
The ‘Yes Man’: AI Won’t Tell You When You’re Wrong
One of the biggest dangers of using AI is that it is essentially a “yes man.” It is designed to be helpful and agreeable, which is the last thing you need when making decisions in this area.
- It won’t tell you you’re being unreasonable: If you’re pushing for an outcome that a judge would never grant, an AI likely won’t pull you up on it. It will just try to help you argue your point. It might give you a great way of expressing your case, but ultimately, it’s not going to persuade a judge.
- It can’t weigh the risks of a judge: A big part of legal advice, is setting out the A solicitor ‘the litigation risk’. The chance that a judge might decide against you, the time it will take to get to a final hearing and what you stand to lose/ gain by getting there. AI doesn’t understand the temperament of the courts or the unpredictable nature of a final hearing.
- It won’t help you settle: AI isn’t great at suggesting when an offer from the other side is actually “good enough” to accept. A human lawyer helps you weigh the stress and cost of continuing against the benefit of settling now.
The Danger of Hallucinations
AI models are built to be helpful, but they aren’t always built to be factual. They often hallucinate. If you ask an AI for a specific legal case to help you, it might hand you a perfectly formatted case name and citation that looks legitimate but is actually a complete invention.
If you rely on fake law in court, the consequences can be fatal. You could find yourself whacked with a large costs order for wasting the court’s and the otherside’s time or even having your application dismissed.
Where AI Can Be Your Friend
None of this is to say, you should never use AI to help you. One thing is for sure, AI is here to stay and even us lawyers are using it. For you, AI can be a great tool to help you write letters when you know everything you want to say but you want some help with the wording.
