The Court Fee

The standard court fee for a divorce application in England and Wales is £612. This is the fee paid to HM Courts & Tribunals Service when the divorce application is submitted. It applies whether the application is made by one person or jointly. The payment is made right at the start of the divorce process when you submit the application.

If you are on a low income or receive certain benefits, you may be able to get help with this fee through the Help With Fees (HWF) scheme. Depending on your circumstances, that could mean a full exemption or a reduction. Eligibility is based mainly on income, savings and benefits. It is worth checking before you apply. What Else Could Add to the Cost?

The £612 court fee only covers the administrative side of the divorce itself. It does not include legal advice, sorting out finances, or resolving issues about child arrangements. Those are usually the areas where overall costs increase.

Solicitor fees vary depending on the level of help you need. A fixed-fee service gives you certainty: you pay a set amount for a defined piece of work, such as help with the divorce application or drafting a consent order. Pay-as-you-go support is more flexible. You only pay for the advice or assistance you actually need. This  works well if your case is straightforward and you are comfortable dealing with some of the admin yourself.

Costs arising from resolving the financial matters are separate from the divorce fee. Even if you agree how to divide money, property, pensions or debts, it is usually sensible to have that agreement turned into a Consent Order. This makes it legally binding. This means that the paperwork is submitted to the court as a paperwork exercise for the Judge to consider, in most cases without you having to attend a hearing. The court fee for a financial order by consent is £60, and there may also be a solicitor’s fee for preparing the paperwork (our fixed fee is £2,000 +VAT = £2,400). If finances are not agreed and a formal financial remedy application is needed, costs can rise significantly.

Child arrangements can also become a separate cost if you and your former partner cannot agree where the children live, when they spend time with each parent, or how important decisions will be made. If matters cannot be resolved through discussion, solicitor negotiation or mediation, a court application about children may be needed. This involves a separate court fee and potentially additional legal costs.
