One of the most commonly asked questions we are asked is, “How much does a Divorce cost?” Of course, anyone seeking to instruct a solicitor about their divorce will have concerns about cost.
Divorce is not one-size-fits-all. These are the key factors to consider when working out how much your divorce will cost.
What legal work are you doing?
The divorce itself is likely to be extremely inexpensive. All but the most technophobic should be able to make their way through the online no fault divorce system. You will need to pay a fee of £612. Alternatively you will be able to apply for an exemption from the court fee if your income is below a certain level.
If you are going through the process of obtaining a financial order then that is usually where your true costs lie.
If you are also in related family proceedings like Children Act proceedings or Family Law Act (injunction proceedings) then it will also make costs mount up.
Can you do any of it yourself?
Some solicitors offer unbundled services. This is where you do some of the work yourself and your solicitor assists you as and when required. You are a litigant in person. The key to making this process work is making sure that you don’t have too many pots on the boil at once (so for example just divorce and finances, or just Children Act proceedings) and ensuring that your solicitor is familiar and able to offer this kind of work.

The asset base
If the available asset base from the marriage is comprised of more than the equity in a house and a small pension, then it is worth investing in your outcome and using a solicitor to assist. Large pensions, company assets, trusts and opaque income streams can be hard to untangle. Timely accurate and strategic advice is worth every penny.
Process
The process you use is going to have an enormous impact on the costs. As a general rule non court dispute resolution methods are less expensive than court based solicitor led dispute resolution. If you have a mediated agreement then it makes complete sense to use a single solicitor service to draw up the agreement. Even if the matter is contentious then either a mediator-led process or arbitration should be considered.
Personality
The single greatest predictor of expense is where one – or even both – of the personalities involved is difficult, toxic or abusive. That kind of personality struggles to exist in a win-win mentality and would often rather see everything burn to the ground than share assets or agree a fair deal.
So, How much does a divorce cost?
The profession is full of financial proceedings that cost more than £100,000. This is a preposterous amount of money even for London divorce costs. A difficult divorce with a spouse who is unreasonable, amidst complex assets, will maybe cost up to £50,000 to arrive at a financial order
Minimising costs is often about the right process for the right case, and having a strategic long term approach. What is your end game? No one enjoys spending money on lawyers. However correct advice can mean the difference in spending £10,000, not £100,000.
